This is a transcription of the will of J.C. Ellis Jr.:

State of Georgia

Walker County

This is the Thirteenth(?) Day of November in the year of our Lord One Thousand Eight Hundred and Ninety (?).
I John. C. Ellis being of sound mind but being of considerable age and knowing that according to nature I must soon
pass from this earth make this my last will & testament I give and bequeath to my five younger children William K.Ellis , Margaret M. Ellis, Leah L. Ellis and David F. Ellis the full use and control of my land to have all they can make on it for the time of five years it being a part of lot no. one hundred and thirty nine (139) in the ninth (?) district and fourth section of Walker County GA and being the house where we now live and containing fifty eight and three fourths(58 3/4)
Acres except (1/2) one half acre being where the graveyard now is and it is to Remain(?) for a family burying ground and all the cows(?) hay and fodder and farming tools_________________________?? for the benefit of my present(?) family.
I give and bequeath to my two daughters Margaret M. Ellis and Leah L. Ellis and my son David F. Ellis my mare & two cows & calves but they are to keep these on the place for the use of the family. I also give my two daughters Margaret M. Ellis and Leah L. Ellis all the household and kitchen furniture for it naturally belongs to them already. And when the time of five years expires the land to be sold except the (1/2) acre removed and the money divided as follows- I give to my son J.W.Ellis fifteen dollars($15.00) and also to my son Thomas T. Ellis fifteen dollars($15.00) to my daughter Nancy J. Wallin twenty five dollars ($25.00) aand the remainder divided between my five younger children but they are to pay all indebtedness and if any one or more should pay more than his or her equal part to have it back and then as equal _______?? of the remainder. If it should become necessary for them to give a mortgage on the land they may do so and when the land is sold let it be the first money paid. I would like W.K. Ellis and David F. Ellis to remain in the house with the two girls. If David should die & leave no heirs of his own, I want his interest to go to the other four of my present family. Signed in the presence of the undersigned witnesses and year above written.
